Senator Darlene Fairley sponsored sb5544

I just found out that my Senator is a secondary sponsor to this bill. I have now sent multiple emails and have called her office. Lets barade her phone lines and show her that this bill is wron please help.

I've heard from constituents on both sides of this issue. The reason I

support this bill is because I really think these noise levels are

affecting the quality of life of some of our neighborhoods. For

example, I've heard of people who build tracks to run their ORVs on in

their backyard. This creates a high noise level that I wouldn't want to

live next to.

For those who don't tinker with the factory-set levels on their ORV and

use their ORVs in most established recreation areas, this bill shouldn't

have any affect.

As our open spaces get developed for housing, the needs of

recreationalists and residents seem to clash more and more. I realize

the vast majority of ORV users are courteous, but the ones who blast the

neighborhoods is what I'm concerned with. That's why I'm supporting a

request in this year's budget to preserve Reiter Trails in Gold Bar as

an official ORV Park, so folks in our area will have an additional

established area to use.

Dear Senator Fairley:

I recently learned that SB 5544 was passed by the Senate consumer

protection committee and is now scheduled to be heard by the rules

committee, despite strong opposition from many Washington State families

and businesses. This bill would all but eliminate my family and friends

ability to enjoy our motorcycles and ATV's off road, and must not be

adopted. The current language contains a provision against "clearly

audible" ORV sound, something that is both subjective and potentially in

conflict with current federal laws. Also included is a provision which

would reward nuisance lawsuits and clog our courts with unneeded

litigation between neighbors by creating an incentive to sue rather than

work towards mutually agreeable solutions. ORV recreation is a family

activity and must not be made illegal for all but those who can afford

to

purchase larger parcels of land away from urban areas. Please support

the

efforts of the Washington State Off Highway Vehicle Alliance (WOHVA),

the

Washington State Motorcycle Dealers Association (WSMDA) and the American

Motorcyclist Association (AMA) and vote against this bill.

I'm sure she doesn't even understand what a db level is.

I know she doesn't! If she thinks that someone who doesn't "tinker" with their stock exhaust won't be affect - she doesn't have all the facts. People like this need to be "enlighten" about what a db is and what the levels are they are talking about. But I think that statement was made just to please the media, I think she truly wants to ban ORV's just like her brother Kline.

I think she need to be enlightened with more facts. I don't think she is totally against orv since she also says she is voting for reiter trails. I wish we could just show the senators what 45db's is. There is a educational lession to be learned.

What are they going to do, issue all the cops a db meters? I can tell you, if I wasn't retired I would NOT write tickets on this stupid bill if it were to become a law. I know a lot of cops that won't. And, let me tell you that it's all up to the law if they write the ticket or not. What is "disturbing" to some is not to others.

Yesterday I met with some of the Senators and at least one staff member for each of the 49 Senators.

The level of understanding was very low.

Some prefer to stay that way, but a lot of others were amazed at their own ignorace and seemed eager to learn.

Hopefully that bit of educating helped.

The db levels were just put there to make people think that they actually knew what they were talking about. The key words were "Plainly Audible" Meaning if they could hear you you could get a ticket. At any rate it seems SB5544 is dead for now. But watch these snakes closely until 5:01 pm March 14th. They may come up with something.
