Subject: US Consumer Products Safety Commission Lead Testing

Mr. Suthers,

Hello, my name is Bryan Bosch and I’m both a Colorado resident and the owner of the largest and most active community of off-road motorcycle & ATV enthusiasts on the planet (215,000+ reg’d members and almost a 500,000 monthly unique visitors).

The reason for contacting you is because Congress in their infinite wisdom passed legislation that requires any product designed for children 12 and under to meet strict lead content requirements. Perfectly reasonable for baby bottles, plates, teddy bears, binkies, etc…, but in their haste, they never bothered to think about what else they might catch in their net.

Whether an unintended consequence or no, as of 02/10, small cc motorcycles, ATVs and their replacement parts are now in effect banned from sale. Of course, this comes at a time when we can’t afford to lose more jobs and the fact is, kids don’t lick, chew, suck on or ingest parts of or their motorcycles and ATVs and nobody can document a case of lead poisoning from these products. According to the motorcycle Industry Council, the financial impact for the power sports industry may top a billion dollars.

The US CPSC did issue a one year stay to get their arms about the chaos this has caused, but dealers are still being held to the testing standard. So regardless, in effect, these products and their replacement parts are banned.

So, why am I contacting you? I’m asking you to bone up on this issue (http://www.cpsc.gov/ABOUT/Cpsia/cpsia.HTML) and to issue a stay for the State of Colorado for a 12 month time period to preserve jobs and to allow the industry to respond to the concern. This has been done by the Attorney General for the State of South Carolina. You can read about it here: http://www.vurbmoto.com/P2D/feature-articles/2223-lead-law-halted-.html

I’m all for protecting our children ( I have two (7 & 8)), but concerning off-road motorcycles and ATVs, this legislation has virtually a zero % chance of protecting kids and a 100% chance of costing people their jobs and decimating a positive family oriented activity.

I thank you for your attention to this matter in advance. Please contact me should you have any questions.

Kind Regards,
