No, a DT50 is a motorcycle (has no pedals).

What do petals have to do with it? Isn't it considered a scooter?

In most states, a moped is defined by top speed/hp and the existence of pedals. Since a DT50 does not have pedals, most states will not allow it to be registered as a moped. I think top speed is an issue too.

In many states, a scooter is also considered a motorycycle.

my moped doesn't have pedals, and it has a moped title. looked it up today, it says it has to have a sticker saying it can't go faster than thirty. damn.. ohwell. it'd be cool if it was considered a moped here.
